In
its Headlines “Impeachment Justified says Legal Fraternity” the Daily News
the Govt. Paper, today only names one hardly consequential individual of a ‘Jayatissa
de Costa’ and hence HOW CAN HE BE THE LEGAL FRATERNITY. For a paper to be so
blasé as to make such insinuations without a qualm is the evidence that
everything the Govt. does is justified.
How
on earth people can say before we know the charges that the Impeachment is
justified is beyond me! This especially as the MPs who signed it were whipped
into signing, as the President would know who have not, and so they would be
making the calls or coming to Colombo to sign it for fear of losing the favor
where their bread is buttered and thus kept firmly under the thumb of the
leader.
It
is really sad that the legal fraternity did not unite against it in unison and
agree to keep out of the Justice system in protest. They did not due to a
couple of reasons. Firstly they have no backbone to fight the regime as they
believe being on the wrong side will affect their lucrative practice. Secondly
they agree with the impeachment as the CJ was completely biased in the Govt.
favor and passed judgments that are completely unjustified in law, reinforcing
this bias and so she should be removed. Anyway it was accepted at the time that
she was a political appointment as a nodding donkey!!
So
when you sleep with the devil you get your just desserts one day, and the day
of reckoning has arrived.
On
the other hand it is ironic, that when she stopped doing the bidding of the
Govt. they decided to impeach her. They decided that they could not control her
and she was no longer a puppet on a string, but one with her own mind!!
Until
we know the charges, except that the Foreign Minister has said she has abused the
law, we cannot judge if this is justified and therein lies the conflict to properly
opine. However ironically yet again the MPs who signed just signed without reading
what the signed, so they don’t know why either.
Further in the UPR in Geneva, the former Atorney General, who is now a Presidential Adviser on legal affairs and also the Chairman of Seylan Bank, also defended the Govt. action, but that is nothing new as that is his job.
The
question is why the Opposition and the BASL are also silent on this matter, and
is it because whatever they do they will be damned, let me explain in the next blog entry.
